His lawyers are arguing that the name 'Slim Shady' has become synonymous with Eminem's rap career, making it 'distinctive and famous.'
Swim Shady, a Sydney-based company that sells beach umbrellas, swim bags, and other accessories, registered its name in September 2023, initially launching as Slim Shade. They even filed for and received a US trademark earlier this year, which triggered Eminem's legal response. Court documents reveal that Eminem trademarked the name 'Slim Shady' back in 1999, coinciding with the release of his album of the same name.
Interestingly, this isn't the first time a legal battle has brewed over brand names. Last year, an Australian court overturned an earlier ruling in a case involving Katy Perry and Australian designer Katie Perry. The designer, who sold clothes under her birth name, accused the pop star of trademark infringement during her 2014 Australian tour.
